Terms of Service
Last updated 21 October 2026
1. Who we are
These terms are an agreement between you and Nine Tenths Studios Inc., a corporation that does business as NineTenths (“NineTenths”, “we”, “us”). Our address is 221 Main St, Suite N, Nashua, NH 03060, USA.
They cover our games and websites, including the Railway Rumblers game at game.railwayrumblers.com, the Railway Rumblers marketplace and gallery at marketplace.railwayrumblers.com and gallery.railwayrumblers.com, and this site, ninetenths.io (together, the “Services”).
2. Agreeing to these terms
By creating an account or using the Services you agree to these terms and to our Privacy Policy. If you do not agree, do not use the Services.
3. Accounts and eligibility
- You must be 18 or older to create an account or use the Services. When you sign up you confirm that you are 18 or older and that you agree to these terms and our Privacy Policy. If we learn that a player is under 18, we will close the account and refund their purchases.
- You sign up with an email address and a password. We send an email to confirm the address. Keep your password private; you are responsible for activity on your account.
- Your account has a username. Your username is public: other players see it, and it is used as your station’s public name in the game. Do not choose a username that is offensive, impersonates someone, or infringes anyone’s rights. If you do not choose one when you sign up, we create one from the part of your email address before the “@”, so you may want to set your own. Usernames cannot be changed in the game at present. If your username is offensive or was created by mistake, contact support@railwayrumblers.com. We may change a username that breaks these terms.
- One account works across our Railway Rumblers game, marketplace and gallery. Accounts are personal. Do not sell, share or transfer your account.
- Tell us at support@railwayrumblers.com if you think someone else is using your account.
4. Your licence to the game and the card art
The Services, the game, its software, rules, characters, names, logos and all artwork, including the art on cards, belong to NineTenths or its licensors and are protected by copyright and other laws.
As long as you follow these terms, we give you a personal, limited, non-exclusive, non-transferable, revocable licence to use the Services for your own non-commercial entertainment. This includes viewing the art on the cards in your collection and displaying it for personal, non-commercial purposes, for example in a screenshot or on your social media. It does not include any commercial use of the art. All intellectual property in the Services and the card art stays with NineTenths or its licensors.
Holding a card, or the token that records it or will record it, does not give you ownership of the artwork, the copyright, the trademarks or any other intellectual property. You may not copy, modify, sell or commercially use our art or software except as these terms allow.
5. Cards, coins and other virtual items
Cards
- Railway Rumblers cards come in card packs. Series 1 has 100,000 cards, regular and premium. You can put cards to work in the game, for example on your trains.
- Each card is, or will be, recorded as a token on the Ethereum blockchain under the ERC-721 standard, in a contract named “Railway Rumblers” (symbol RRC). We will publish the contract address once it is deployed on Ethereum mainnet.
- We hold the cards for you. The tokens are, or will be, held in a wallet controlled by NineTenths on your behalf (“custodial” holding). Our records say which cards are assigned to your account. You do not need your own crypto wallet to play.
- In the future we may let players move cards to a wallet they control. If we do, we will publish the rules for it, which may include fees, limits and eligibility checks. We do not promise that this will happen, or when.
Coins and resources
The game also has in-game coins, resources, paint and similar items that you earn by playing. At present, coins and these other items cannot be bought with real money. If that changes, we will update these terms.
No cash value
- Cards, coins and all other virtual items have no cash value. They cannot be redeemed, exchanged or cashed out for money or anything of monetary value from us.
- We do not operate a way to sell cards for money. Card trading in the game is card-for-card only (see Car Swap).
- Virtual items are licensed to you under these terms; they are not your property, and you may not sell or transfer them outside the Services, except through a feature we provide for that purpose (such as a future option to move cards to your own wallet).
- We may change, rebalance or retire virtual items and how they work in the game (see section 10).
6. Purchases and refunds
- The game is free to play. You can choose to buy card packs on the Railway Rumblers marketplace. Prices are shown in US dollars before you pay. Applicable sales taxes may be added at checkout.
- Card payments are processed by Stripe. We do not receive or store your full card number.
- Packs can be limited in number and can sell out. When your payment is confirmed, the pack’s cards are assigned to your account. Pack contents are published: a Founder pack has 7 regular and 3 premium cards, and a First Edition pack has 9 regular and 1 premium card. Within those groups, the cards are assigned at random from the series; we do not promise any particular card. Card rarity odds will be published on the marketplace.
- Refunds. All sales are final, except where the law requires a refund or where a purchase failed to deliver (for example, you were charged but the pack’s cards did not arrive in your account). In those cases, contact support@railwayrumblers.com. If a purchase is refunded or charged back, we may remove the cards from that pack from your account.
- If a payment goes through but we cannot supply the pack (for example, the last pack sold while you were paying), we refund the payment.
7. Car Swap (card trading)
- Car Swap lets players trade cards with each other inside the game. Trades are one card for one card. No money changes hands, and you cannot buy or sell cards for coins or money through Car Swap.
- When you list a card or make an offer, that card is held so it cannot be used elsewhere until the listing or offer ends. When a trade is accepted, both cards move between the two accounts at once. Accepted trades are final and we do not reverse them, except to fix an error on our side or to deal with a breach of these terms.
- The rules for listings and offers (what counts as a match, fees in coins, how long a listing lasts) are part of the game rules and may change.
- Do not arrange trades in exchange for money or anything else outside the game. We may cancel such trades and act under section 11.
8. Acceptable use and cheating
You agree not to:
- cheat, exploit bugs, or use bots, scripts, macros or modified clients to play or to gain an advantage;
- run several accounts to gain an advantage, or create accounts in bulk;
- interfere with, overload, probe or attack the Services, or try to get into accounts or systems that are not yours;
- buy, sell or trade accounts, cards or virtual items for money or outside the Services;
- harass other players, or use usernames, station names or other content that is abusive, hateful, sexual, unlawful or that impersonates others;
- use the Services in a way that breaks the law.
If you find a bug or exploit, please report it to support@railwayrumblers.com instead of using it.
9. Public information
Some things about you are visible to others: your username and station name, your station and its level, badges shown beside your name (for example “Founder” and “VIP Founder”; the VIP Founder badge shows that you bought a card pack), and cards you list for trade. We may add public pages that show a player’s station and trains. Details are in the Privacy Policy.
10. Changes to the game and its rules
The game is a live service and will change. The game’s rules (for example values, capacities, cooldowns, prices in coins, market and trading rules) are versioned on our servers, and we publish new versions from time to time. We may add, change or remove features, content and virtual items, and we may rebalance the game, including in ways that change what your cards, coins or other items do. We may also stop offering a game or a feature. Where a change materially reduces something you paid for, we will tell you in advance where we reasonably can.
If we shut down a game, the cards we hold for you are, or will be, recorded as tokens on the Ethereum blockchain. We will give you reasonable notice before the shutdown and, where possible, the option to move your cards to your own wallet before it happens.
11. Suspension and termination
- You can stop using the Services at any time. To close your account, email support@railwayrumblers.com.
- We may suspend or close your account, remove virtual items, cancel trades or reverse in-game gains if you break these terms, if required by law, or to protect players or the Services.
- If your account is closed, your licence ends and you lose access to the game and the virtual items in it, unless the law requires otherwise. The cards held for you are, or will be, recorded as tokens on the Ethereum blockchain. Unless your account was closed for a serious breach of these terms, we will give reasonable notice and, where possible, the option to move your cards to your own wallet.
- Sections 4 (ownership of IP), 5 (no cash value), 12, 13 and 14 continue after termination.
12. Disclaimers
The Services are provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Services will be uninterrupted, error-free or secure, or that any data or virtual item will be preserved.
Blockchains are run by third parties. We do not control the Ethereum network and are not responsible for its fees, delays, outages or changes. Cards and tokens are game items, not investments; we make no promise about their value, and you should not buy packs expecting a financial return.
13. Limitation of liability
To the fullest extent the law allows, NineTenths will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or virtual items. Our total liability for any claim relating to the Services is limited to the amount you paid us in the 12 months before the claim. Some places do not allow these limits, so they may not apply to you.
Indemnity. You agree to indemnify and hold harmless NineTenths and its officers, employees and agents from any claims, losses and costs (including reasonable legal fees) arising from your breach of these terms or your misuse of the Services, to the extent the law allows.
14. Governing law and disputes
These terms are governed by the laws of the State of New Hampshire, USA, without regard to its conflict-of-law rules. Before bringing a claim, please contact us so we can try to resolve it informally. If we cannot, any dispute will be decided by the state or federal courts located in New Hampshire, and you and we agree to their jurisdiction. Either of us may instead bring a claim in small claims court if it qualifies. Nothing in these terms takes away rights you have under consumer protection laws that cannot be waived.
15. Changes to these terms
We may update these terms. We will change the “last updated” date above and, for material changes, tell you in the game or by email before they take effect. If you keep using the Services after that, the new terms apply.
